I have asked for solid reasons and fact as to "WHY" these cracks would fail. No one has been able to give me any. I would be taking a gamble on it holding off as I would on it failing as far as I see it.
For me, if the tank breaks with in the next year, they will replace it. And I have to deal with the aftermath... If it lasts longer, I won...
Please call me crazy!!! It's just my "thought process"... All that being said, I am not sure what exactly I will do...

That tank is not right. The panels had to move, scrap against one another during shipping to get edge scallop chips to appear. So there is not 100% silicone between the edge of one panel to another, maybe only 75% in those places. When the panels moved to cause these chips where else is there not 100% adhersion of the siniclone between the panels. Are you gambling man? How many years do you plan on having this tank?
The manufacturer is going to try to get out of it the cheapest way, pay you off instead of building you a new tank. Do not accept that! They are not your ally, you'll be left holding the bag should something happen.
You don't want to deal with the aftermath. I dealt with insurance companies, appraisers and contractors for many months for a 15 gallon/$10,000 accident. It drove my downstairs neighbor and myself crazy.
Good luck with MA consumer protection laws. Civil laws often times have to be pushed and forced by the victim to be enforced. Good luck with that along with getting any money from an insurance company once they find out the failed tank was known to be faulty from the start by the user and manufacturer but filled and used anyways. Better lawyer up, the insurance company has!
